& Conditions
This a legal and binding agreement between you and Dennis Hardley
partnership relating to the use of the aforementioned company's
website, downloading image files from such a website and the licensing
of images by Dennis Hardley Partnership to you.
When you download image files from this website or receive image
files from Dennis Hardley Partnership through any other means, or
receive images by film or any other medium you agree to accept all
the terms of this agreement. If your actions are on behalf of an
employer or another third party all terms and conditions apply to
you.
Copyright/Intellectual Property
The Copyright and all intellectual property rights of purchased
images remains with the Photographer or owner namely Dennis Hardley
partnership.
Reselling
Images are not sold but licenced through a Royalty Free or Rights
managed licence agreement. Images cannot be resold.
All images licenced by Dennis Hardley Partnership, whether rights
managed or Royalty free are copyrighted and protected by Scottish,
English and Welsh property law and also the Berne Convention. Images,
other than watermarked images, may only be used commercially once
you have entered into a licence agreement and paid the relevant
fee.
Watermarked images may only be used for you internal comps and
layouts. Dennis Hardley Partnership does not grant you any licence
to use theses images in any final materials distributed either internally
and externally by yourself or your company, including any electronic
or online system.
Royalty FreeAll licences granted as Royalty Free are for non-exclusive use.
Rights Managed
Rights Managed licences granted are exclusive for the specified
purpose and period stated or listed.
Terms of Use
You are entitled to download comping files, whether Rights Managed
or Royalty Free images, from Dennis Hardley partnership website
subject to terms of this agreement.
Duplicate Files
The Dennis Hardley partnership cannot provide a copy of an image
file should you accidentally delete or lose it after purchase and
successful download. (Images are stored on our servers for 120 days
from the date of the event and then deleted.)
Unlawful Publication
Unlawful publication is subject to a minimum £1000 charge.
Returns/Refunds Policy
Under section 6./1(e) of the consumer protection (Distance Selling
Regulations 2000), the purchase of these items is exempt from the
statutory seven days cooling off (refund) period. Once payment has
been made and accepted, the electronic files cannot be returned
to us for a refund or exchanged for a different file.
We sell digital images and photographic prints.
The Dennis Hardley Partnership cannot be held liable for actions
or failures of any third party suppliers.
